TYPE I – Rezone


Request:  The purpose of this proposal is to amend the Future Land Use designations and apply a new overlay zone on several properties, which make up the block surrounded by West Broad Street, North Milledge Avenue, North Chase Street and Reese Street. In October 2018 the Athens-Clarke County Mayor and Commission proposed the adoption of a special district overlay for the subject area, including a change of zoning to C-G (Commercial-General). Consequently, the Future Land Use designations of Main Street Business and Traditional Neighborhood must also change to General Business to align the Future Land Use designation with the proposed C-G zoning and West Broad Street Special District Overlay. The following purpose statement is included in the proposed associated zoning text amendment establishing the West Broad Street Special District Overlay: The purpose of the West Broad Street Special District Overlay is to address issues of public safety, health, and general welfare, including controlling the visual and architectural character of the West Broad Street Special District Overlay. The use of design requirements will help to ensure that new development is visually and functionally compatible with the unique character of the transition area containing commercial, residential and institutional uses.

TYPE I – Future Development Map Amendment


Request:  The purpose of this proposal is to correct the Future Land Use designation on several properties adjoining or in close proximity to Cherokee Road and Beaverdam Road. The Athens-Clarke County Planning Department is proposing that the Future Land Use designation of Rural be returned to Single Family Residential to align the Future Land Use designation with the predominate development pattern of the area. The subject area had the Single Family Residential designation prior to the recent adoption of the 2018 countywide Future Land Use Map. The change to the Rural designation was unintentional.

TYPE II – Special Use Permit


Request:  The purpose of this request is to seek approval of a Special Use Permit for a surface parking lot within the C-D DS (Commercial-Downtown; Dougherty Street) zoning district. According to Section 9-10-2 of the Athens-Clarke County Zoning and Development Standards, a commercial parking lot is permitted with Special Use Permit approval within the C-D zoning district. In its present state, the property contains one building comprised of two separate structures that share common walls as well as an existing surface parking lot. The applicant is requesting to demolish the existing building to utilize the on grade slab in order to expand the existing surface parking lot. A Demolition Permit has been received by the Planning Department. The application report and site plan submitted with this request will become binding for the project upon approval of the Special Use Permit. No structures have been proposed with this application; therefore, architectural elevations have not been submitted.

TYPE II – Preliminary Planned Development


Request:  The purpose of this request is to rezone a 0.511-acre subject property and a 0.148-acre section of former railroad right-of-way from E-I (Employment-Industrial) to E-O (PD) (Employment-Office – Planned Development) in order to reestablish an office use in a former railroad switch house and construct a single-family dwelling on the subject property. Rezoning the subject property from E-I to E-O (PD) is in harmony with the Future Land Use map designation of Employment Center. The planned development is proposed since the request includes exceptions or variations to the development standards in an effort to provide design flexibility. A total of five wavers are requested at this time. The request for a planned development includes a binding application report and site plan in an effort to guarantee the community that what is proposed will be constructed.
