NOTICE OF FINDING OF NO SIGNIFICANT IMPACT AND
NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS

These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the Unified Government of Athens-Clarke County.


REQUEST FOR RELEASE OF FUNDS

On or after July 25, 2018, the Unified Government of Athens-Clarke County will submit a request to the Department of Housing and Urban Development for the release of Community Development Block Grant (CDBG) funds to undertake the new construction of a pathway between East Carter Drive and the East Athens Community Center at 400 McKinley Drive, Athens, GA 30601. The Nellie B Trail project will include clearance, pathway construction, fencing, retaining wall, information kiosk, bulletin kiosk, street lights, stairs with handrail, and storm water features.


This new construction of a sidewalk will occur in a low-to-moderate income neighborhood.  Total new construction costs for the Nellie B Trail project is $95,450.00 in CDBG funds. The property between East Carver Drive and 400 McKinley Drive is located within the legal jurisdiction of the Unified Government of Athens-Clarke County, Georgia. 


FINDING OF NO SIGNIFICANT IMPACT

The Unified Government of Athens-Clarke County has determined that the project will have no significant negative impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the Housing and Community Development Department located at 375 Satula Avenue, Athens, GA and may be examined or copied weekdays 8:00 A.M. to 5:00 P.M.


PUBLIC COMMENTS

Any individual, group, or agency disagreeing with this determination or wishing to comment on the project may submit written comments to the Unified Government of Athens-Clarke County Housing and Community Development Department. All comments received before July 25, 2018 will be considered by the Unified Government of Athens-Clarke County Housing and Community Development Department prior to authorizing submission of a request for release of funds. RELEASE OF FUNDS

The Unified Government of Athens-Clarke County Housing and Community Development Department certifies to the Department of Housing and Urban Development that Nancy Denson in the capacity as Mayor consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. The Department of Housing and Urban Development's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows the Unified Government of Athens-Clarke County to use Community Development Block Grant funds.


OBJECTIONS TO RELEASE OF FUNDS

The Department of Housing and Urban Development will accept objections to its release of funds and the Unified Government of Athens-Clarke County's certification for a period of fifteen (15) days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following basis: (a) the certification was not executed by the Certifying Officer of the Unified Government of Athens-Clarke County; (b) the Unified Government of Athens-Clarke County has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by the Department of Housing and Urban Development; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58) and shall be addressed to the Department of Housing and Urban Development, Community Planning and Development at 40 Marietta Street, Atlanta, GA  30303. Potential objectors should contact the Department of Housing and Urban Development to verify the actual last day of the objection period.
