Probate Court

*************************** COVID19 NEWS FLASH ****************************

During the statewide judicial emergency, Probate Court was only handling emergencies and other urgent matters by appointment only. The judicial emergency expired at midnight on June 30, 2021. Weapons Carry License applications will still be by appointment only through August 1, 2021.  All of our appointments are currently full but you may apply in person after August 2, 2021.

While appointments are no longer required for other matters, parties are encouraged to submit those by mail when possible.

Process of Weapons Carry License applications:

New applications must be completed up to the point of signing before a Court Clerk. We will verify that your ID shows that you are a Clarke County resident. Application fee payment will need to be separate payments of $73.25 payable to Probate Court and $5.00 payable to ACC Sheriff’s Office. To ensure social distancing, no more than two people at a time are allowed in the waiting area.

Renewal applications must be mailed in, when possible. Please have your signature notarized and include any supporting documentation with your application. The fee for renewal is $30.00 payable to Probate Court and a separate fee of $5.00 payable to the ACC Sheriff’s Office.

The exception to the renewal mail in process is that if you are applying for a renewal in Clarke County, but you originally received your license from another county you cannot apply by mail. You will need to walk-in (apply in the office) after August 2, 2021.

ALL WEAPONS CARRY LICENSE APPLICATIONS MUST BE COMPLETED BEFORE YOU COME IN FOR YOUR APPOINTMENT. APPLICATIONS ARE ON OUR WEBSITE OR CAN BE MAILED TO YOU WHEN YOU MAKE YOUR APPOINTMENT. ANYONE ARRIVING FOR A SCHEDULED APPOINTMENT WITH AN INCOMPLETE APPLICATION WILL HAVE TO COME BACK TO APPLY IN PERSON AFTER AUGUST 2, 2021.

According to the Governor’s Executive Orders effective May 8, 2020 and June 30, 2021, if your license expired between FEBRUARY 13, 2020 and JULY 30, 2021, you have 120 days (not the statutory 30 days) after the expiration date on the face of the license to apply for a renewal license. The Executive Order declaring a State of Emergency for Continued Covid-19 Economic Recovery, which authorizes the extension of time to apply for a renewal license, shall terminate on July 30, 2021, unless it is renewed by the Governor.

Responsibilities

The Probate Court of Athens-Clarke County handles a variety of matters, including guardianships of minors and incapacitated adults, cases involving decedent’s estates, and mental health evaluations and/or treatment, as well as other miscellaneous types of cases such as birth certificate amendments, boundary line disputes, and certain cases concerning trusts. Additionally, applications for marriage and weapons carry licenses are processed in Probate Court. We DO NOT ACCEPT and process marriage and weapons carry license applications before 9:00 am or after 3:00 pm. Acceptable payment is cash, check, or money order ONLY.

The Probate Court also monitors the handling of funds by many fiduciaries, for example, conservators of the property of a minor or incapacitated adult and any estate administrators who have not been relieved by the heirs of accounting to the court. This court does not handle traffic cases or probation for criminal sentences. While we do issue marriage licenses, we generally do not perform marriage ceremonies.
